Terms of Use

1. Definitions

• Platform: the Amistayapp website and application, including all of its features.
• User: anyone with an account on the platform, whether a Guest, Host, or Representative.
• Host: a user who lists a property (or room) for hospitality.
• Guest: a user who requests and completes a booking.
• Representative: a user granted a special role by Amistayapp's administration, enabled to refer new Hosts through their own coupon, in exchange for a commission.
• Invite: the mechanism through which access to the platform is granted, forming a chain of trust between the person inviting and the person invited.

2. About Amistayapp

Amistayapp acts as a marketplace intermediary, connecting Hosts and Guests. Amistayapp does not own, lease, or operate the listed properties, and is not a party to the hospitality agreement made between Host and Guest. Amistayapp's role is to provide the technology, payment processing, and trust mechanisms (invites, reviews, reporting) that make the transaction possible.

3. Signup and Invite-Only Access

Access to Amistayapp is restricted and granted exclusively through an invite from an already-registered user, forming a traceable chain of trust between the person inviting and the person invited. Each invite link has a set expiration and cannot be reused once expired or used.

Amistayapp does not perform institutional confirmation of a user's congregation, circle, or religious affiliation. Trust on the platform comes from the invite chain, each account is linked to whoever invited it, not from external validation. The user is responsible for inviting only people they know and trust, and acknowledges that Amistayapp does not guarantee, verify, or take responsibility for the accuracy of any self-declared community or group affiliation.

The user must provide truthful information at signup and is responsible for keeping their password confidential. Password recovery is available in case of forgetfulness, subject to identity verification of the account holder.

4. User Account

• Full legal capacity is required to create an account.
• Each person may maintain only one active account.
• The platform is available in Portuguese and English, with the user choosing their own language.
• Amistayapp may suspend or terminate accounts that violate these Terms, at the administration's discretion, via the admin panel.

5. Listings and Bookings

A Host may list an entire property or a specific room within a property. The booking flow works as follows: (i) the Guest requests a booking; (ii) the Host approves or declines the request; (iii) once approved, the Guest completes payment; (iv) the booking is automatically confirmed once payment is confirmed.

The Host is solely responsible for the accuracy of the listing's information, including photos, description, price, availability, and house rules included in the property description.

6. Pricing, Payments, and Split of Funds

Payments are processed through a third-party payment provider (Stripe). For each paid booking, the amount is automatically split between: the platform's commission, the payout to the Host, and, where applicable, cleaning and management fees configured for the property.

Guests outside Brazil may pay in US dollars, automatically converted at the day's exchange rate. The Host receives the corresponding amount in Brazilian reais as usual, with no difference resulting from that conversion.

7. Representative Program

Amistayapp may grant, at the administration's sole discretion, the role of Representative to certain users. The Representative receives their own coupon (auto-generated or custom) and a commission percentage set by Amistayapp.

• A Host may enter a Representative's coupon when registering their property, a single time, permanently.
• The Representative's commission percentage is frozen on the property at the moment the coupon is linked. Later changes to the Representative's default percentage do not affect properties already linked.
• The Representative's commission is deducted exclusively from the platform's own commission share, never from the amount received by the Host or by other beneficiaries of the split (cleaning, management).
• The Representative receives their commission through their own account connected to the payment provider.
• Amistayapp may revoke the Representative role at any time. Revocation prevents new links to the coupon, but does not affect the commission on properties already linked before the revocation.

8. Cancellations and Refunds

In the event of a date conflict between bookings, the refund to the Guest is processed automatically. Outside of that case, the cancellation policy applicable to each booking is the one set by the Host when the listing was published, and should be reviewed before confirming a booking.

9. Reviews

At the end of each stay, Host and Guest may review one another. Reviews are a core trust element on the platform and cannot be removed, except in cases of proven violation of these Terms.

10. Communication Between Users

Amistayapp provides a chat channel between Guest and Host for communication related to the booking. Using the chat for purposes unrelated to the hospitality relationship, or to circumvent the platform's payment and security mechanisms, is prohibited.

11. User Conduct and Reports

Any user may report another user directly through the platform. Reports are reviewed by the administration, which may suspend or ban accounts for violations of these Terms, unlawful or discriminatory conduct, or conduct that endangers the safety of other users.

12. Host Responsibilities and Legal Compliance

The Host is responsible for knowing and complying with all laws applicable to hospitality in their location, including local regulations, condominium rules, and tax obligations. Amistayapp does not provide legal advice, and information provided on the platform is for informational purposes only.

13. Intellectual Property

All platform content (brand, logo, layout, code) is owned by Amistayapp. Content published by the user (photos, descriptions) remains their own property, but the user grants Amistayapp a license to display it on the platform and in promotional materials.

14. Disclaimer of Warranties

The platform is provided "as is". Amistayapp does not guarantee that the service will be uninterrupted or error-free, nor does it guarantee the quality, safety, or legality of properties listed by Hosts.

15. Limitation of Liability

To the maximum extent permitted by Brazilian law, Amistayapp's liability for any dispute related to the platform is limited to the amount actually paid or received by the user through the platform in the 12 months preceding the triggering event.

16. Indemnification

The user agrees to indemnify Amistayapp for any losses, damages, or expenses arising from the user's breach of these Terms or of applicable law.

17. Governing Law and Jurisdiction

These Terms are governed by Brazilian law, regardless of the user's country of residence. The courts of Amistayapp's domicile are elected to resolve any disputes, with the user waiving any other, however privileged.

18. Changes to These Terms

Amistayapp may change these Terms at any time, upon notice to the user. Continued use of the platform after a change constitutes acceptance of the new Terms.
